  • Applications may collect data under the scope described in our Privacy Policy.
    Updates: Novus reserves the right to roll out updates or remove app features at our discretion.
    AI Features: Our applications may include features that utilize artificial intelligence (AI) provided by third-party services, such as OpenAI. By using these AI features, you agree to the terms and conditions of these third-party providers, which may include the use of your data to train their AI models.     You acknowledge and agree that:
  • AI-generated content may contain inaccuracies, biases, or other issues inherent to the technology.
  • We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
  • You are solely responsible for reviewing and validating any AI-generated content before using or relying on it.
  • We reserve the right to showcase developed products and services for any reason including but not limited to sales, advertisements, collaborations.

4. Client Terms for Custom Services
If you engage Novus for custom design or development services, the following terms apply:
4.1. Payment Terms:

  • Invoices and Payment Deadlines: Payment must be made within 30 days from the invoice date unless otherwise agreed in writing.
  • Non-Payment Consequences: If payment is not received by the deadline:
    • Late fees may apply (e.g., 2% monthly interest on outstanding amounts).
    • Novus may suspend or revoke client access to delivered work.
      4.2. Ownership and Intellectual Property:
  • Ownership Transfer: Ownership of all deliverables (e.g., designs, applications) will transfer to the client upon full payment of all fees.
  • Retained Rights: Novus retains the rights to:
    • Use work for internal portfolio or marketing purposes.
    • Reuse general design elements or code snippets not specific to the client.
  • Client Usage: Clients may only use deliverables as agreed in prior written contracts. Unauthorized reproduction, modification, or redistribution is prohibited.
    4.3. Revisions and Scope:
  • Revisions: Reasonable revisions are included within the initial scope, up to three rounds, unless otherwise stated. Additional revisions will be charged at prevailing rates.
  • Scope Creep: Any work falling outside the agreed project scope will require an additional fee and a written amendment to the contract.

5. Refunds and Cancellations
Refund Policy:

  • No refunds are offered once a project is completed and approved by the client.
  • Cancellations mid-project may result in forfeiture of the deposit and additional charges for work completed up until cancellation.
    Subscription-Based Services: Subscriptions to applications or features provided by Novus can be canceled with 30 days’ written notice.

6. Third-Party Links
Our website or applications may contain links to third-party sites or services. We are not responsible for the practices or content of these linked sites. Use them at your own risk.

7. Limitation of Liability
To the maximum extent permitted by law:

  • Novus is not liable for indirect, incidental, or consequential damages arising from:
    • Use of the website, services, or applications, including any AI features.
    • Errors, interruptions, or data loss caused by third parties, including third-party AI providers.
  • In no case shall Novus’s liability exceed the amount paid by the client for services rendered, if any.

All use of the website, applications, and services is subject to our Privacy Policy, which outlines how we collect, use, and protect user and client data.

9. Termination
Novus reserves the right to terminate or suspend access to the website, applications, or services, including any AI features, if you violate these Terms or engage in harmful or unlawful activities.
In the event of termination, we will make reasonable efforts to minimize any disruption and data loss, but we are not responsible for any loss of service or compensation.

10. Indemnification
You agree to indemnify, defend, and hold harmless Novus Labs, its officers, directors, employees, agents, and third-party service providers from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees and costs) arising out of or in connection with:

  • Your use of our website, services, or applications, including any AI features.
  • Your violation of these Terms or any applicable law or regulation.
